1. QVO Values B.V. (hereinafter referred to as: “ QVO Values ”) respects your privacy and processes personal data in the capacity of controller in accordance with the European General Data Protection Regulation (hereinafter referred to as: the “ GDPR ”).

2. This Privacy Policy was last updated on September 1, 2023. QVO Values reserves the right to unilaterally change or supplement this Privacy Policy. You are therefore advised to consult this Privacy Policy regularly. If there are material changes to this Privacy Policy, a clear notification will follow on the website.

4. Personal data means any information about an identified or identifiable natural person. QVO Values can process, among other things, the following personal data:

• Data regarding your visit to the QVO Values website;
• Personal data that you provide QVO Values for an application, such as your first and last name, date of birth, address, telephone number, nationality, marital status and all other personal data stated in your application;

QVO Values collects this personal data because you have provided it to QVO Values. For example, because you provide data when entering into an agreement with QVO Values, your details have been entered on the QVO Values website, you have given your business card or you have applied for an internship or job. QVO Values may also obtain your personal data from other sources, such as a local lawyer, counterparties, the Trade Register, the Land Registry or by using public sources.

6. QVO Values may use your personal data for the following purposes:

• To provide valuation services, in the broadest sense of it;
• To comply with the legal and statutory obligations imposed on QVO Values;
• For marketing and business development activities, such as newsletters, invitations to events, workshops and other marketing communications that may be of interest to you;

• Third parties to whom QVO Values provides your personal data are themselves responsible for compliance with privacy legislation. QVO Values is not responsible or liable for the processing of personal data by these third parties. To  the extent that a third party processes your personal data in the capacity of a processor of QVO Values, QVO Values will conclude a processing agreement with such a third party that meets the requirements described in  the GDPR.
• In order to provide the services of QVO Values, it may be necessary for us to transfer your personal data to a recipient in a country outside the European Economic Area. In that case, QVO Values will ensure that such transfer of data is in accordance with the applicable laws and regulations.

Your rights

12. As a data subject, you have the following rights:

• The right of access. This means that you can request access to the personal data that QVO Values has collected from you. You must take into account that there may be circumstances in which QVO Values is authorized, for example due to a right of professional privilege, not to comply with your request to provide copies of personal data;
• The right to rectify or correct your data if it is incorrect or incomplete;
• The right to deletion of your personal data. You must take into account that circumstances may arise in which QVO Values is obliged to retain your data in order to comply with legal and statutory obligations to which QVO Values is subject;
• The right to object to or request restriction of the processing of your personal data. Again,  there may be circumstances in which QVO Values is legally authorized not  to comply with your request;
• The right to data portability. This means that you have the right to receive the data that QVO Values has about you. This only concerns digital data. Furthermore, this exclusively concerns personal data that QVO Values either processes with your permission or to execute an agreement with you. The data will be provided in a structured, commonly used and machine-readable format. You have the right to transfer this data to another controller;
• The right to object to profiling;
• The right to file a complaint with a supervisory authority;
• The right to withdraw the given consent. Once again, there may be circumstances in which QVO Values is authorized to continue processing your data, in particular if its processing is a requirement to comply with QVO Values's legal and statutory obligations.

1. QVO Values B.V. (hierna te noemen: “QVO Values”) respecteert uw privacy en verwerkt persoonsgegevens in de hoedanigheid van verwerkingsverantwoordelijke conform de Europese Algemene Verordening Gegevensbescherming (hierna te noemen: de “AVG”). 

2. Dit Privacybeleid is voor het laatst bijgewerkt op 1 september 2023. QVO Values behoudt zich het recht voor om dit Privacybeleid eenzijdig te wijzigen of aan te vullen. U wordt om die reden     aangeraden dit Privacybeleid regelmatig te raadplegen. Wanneer er sprake is van wezenlijke wijzigingen in dit Privacybeleid, volgt een duidelijke kennisgeving op de website.

3. In dit Privacybeleid wordt het volgende toegelicht.

• Welke persoonsgegevens QVO Values verzamelt en op welke wijze;
• Voor welke doeleinden en om welke redenen QVO Values uw persoonsgegevens verwerkt;

Persoonsgegevens

4. Met persoonsgegevens wordt alle informatie over een geïdentificeerde of identificeerbare natuurlijk persoon bedoeld. QVO Values kan onder meer de volgende persoonsgegevens verwerken:

• Basisgegevens zoals uw voor- en achternaam, tussenvoegsel, titel;
• Contactgegevens zoals uw e-mailadres, postadres en telefoonnummer;
• Gegevens betreffende het apparaat dat u gebruikt om de website van QVO Values te bezoeken, zoals een IP-adres;
• Gegevens betreffende uw bezoek aan de website van QVO Values;
• Persoonsgegevens die u QVO Values verstrekt ten behoeve van een sollicitatie, zoals uw voor- en achternaam, geboortedatum, adres, telefoonnummer, nationaliteit, burgerlijke staat en alle overige in uw sollicitatie vermelde persoonsgegevens;
• Alle overige op u betrekking hebbende persoonsgegevens die u QVO Values verstrekt of die QVO Values kan verkrijgen in verband met de doeleinden en op basis van de grondslagen zoals hierna worden vermeld.

5. QVO Values verzamelt deze persoonsgegevens omdat u deze aan QVO Values heeft verstrekt. Bijvoorbeeld omdat u data verstrekt bij het aangaan van een overeenkomst met QVO Values, uw gegevens op de website van QVO Values zijn ingevoerd, u uw visitekaartje heeft gegeven of u heeft gesolliciteerd naar een stageplek of baan. QVO Values kan uw persoonsgegevens ook verkrijgen uit andere bronnen, zoals via een accountant, het Handelsregister, het Kadaster of door gebruik te maken van  openbare bronnen.

Doeleinden en grondslagen voor de verwerking van persoonsgegevens

6. QVO Values kan uw persoonsgegevens voor de volgende doeleinden gebruiken: 

• Om waarderingsdiensten te verstrekken, in de breedste zin van het woord;
• Om aan de juridische en wettelijke verplichtingen zoals die op QVO Values rusten, te voldoen;
• Voor marketing en business development activiteiten, zoals nieuwsbrieven, uitnodigingen voor events, workshops en andere marketinguitingen die voor u van belang kunnen zijn;
• Voor het behandelen van uw sollicitatie;
• Voor het genereren van statistieken betreffende het gebruik van de website en/of om de website te analyseren en te verbeteren.

7. QVO Values verwerkt uw persoonsgegevens op basis van één of meerdere van de volgende grondslagen: 

• De uitvoering van een overeenkomst;
• Het voldoen aan een wettelijke verplichting;
• Gerechtvaardigd belang;
• Uw toestemming.

8. QVO Values bewaart uw persoonsgegevens niet langer dan nodig is voor het bereiken van de in dit Privacybeleid genoemde doeleinden dan wel om aan wet- en regelgeving te voldoen.

Delen met anderen

9. Voor de in dit Privacybeleid beschreven doeleinden kan QVO Values  uw persoonsgegevens delen met een vennootschap die behoort tot de groep van QVO Values. In bepaalde gevallen kan QVO Values uw persoonsgegevens ook delen met derden, waaronder maar niet beperkt tot:

• Derden die relevant zijn voor de waarderingsdiensten die QVO Values verstrekt, zoals accountants, belastingautoriteiten, regelgevingsinstanties en overheidsinstellingen;
• Derden, zoals toezichthouders en andere instanties, om aan wettelijke verplichtingen te voldoen;
• Externe leveranciers in verband met de verwerking van uw persoonsgegevens voor de in dit Privacybeleid omschreven doeleinden, zoals ICT leveranciers, leveranciers van communicatiediensten dan wel nadere leveranciers aan wie QVO Values bepaalde ondersteunende diensten uitbesteed.

10. Doorgifte van uw persoonsgegevens naar bovenstaande derde partijen vindt uitsluitend plaats voor de in dit Privacybeleid genoemde doeleinden en uitsluitend op basis van de in dit Privacybeleid vermelde grondslagen.

• Derden aan wie QVO Values uw persoonsgegevens verstrekt, zijn zelf verantwoordelijk voor de naleving van de privacywetgeving. QVO Values is niet verantwoordelijk of aansprakelijk voor de verwerking van persoonsgegevens door deze derden. Voor zover een derde uw     persoonsgegevens verwerkt in de hoedanigheid van een verwerker van QVO Values sluit QVO Values met een dergelijke derde een verwerkersovereenkomst af die aan de in de AVG omschreven vereisten voldoet.
• Om de diensten van QVO Values te kunnen verstrekken kan het nodig zijn dat wij uw persoonsgegevens doorgeven aan een ontvanger in een land buiten de Europese Economische Ruimte. In dat geval zal QVO Values erop toezien dat dergelijke doorgifte van gegevens in overeenstemming is met de geldende wet- en regelgeving.

 Beveiliging

11. QVO Values heeft passende technische en organisatorische maatregelen genomen om uw persoonsgegevens te beveiligen tegen ongeoorloofde of onrechtmatige verwerking en tegen verlies, vernietiging, schade, aanpassing of bekendmaking. Uw rechten

12. U beschikt als betrokkene over de volgende rechten:

• Het recht op inzage. Dit betekent dat u een verzoek kan doen om  inzage te krijgen in de persoonsgegevens die QVO Values van u heeft verzameld. Daarbij dient u er rekening mee te houden dat er zich omstandigheden kunnen voordoen waarin QVO Values bevoegd is niet te voldoen aan uw verzoek om kopieën van persoonsgegevens te verstrekken;
• Het recht op rectificatie of verbetering van uw gegevens indien deze onjuist of onvolledig zijn;
• Het recht op verwijdering van uw persoonsgegevens. Daarbij dient u er rekening mee te houden dat er zich omstandigheden kunnen voordoen waarin QVO Values verplicht is om uw gegevens te bewaren om op QVO Values rustende juridische en wettelijke verplichtingen te voldoen;
• Het recht om bezwaar te maken tegen of te verzoeken om beperking van de verwerking van uw persoonsgegevens. Nogmaals, er kunnen zich omstandigheden voordoen waarin QVO Values wettelijk bevoegd is om niet aan uw verzoek te voldoen;
• Het recht op dataportabiliteit. Dit houdt in dat u het recht heeft om uw gegevens te ontvangen die QVO Values van u heeft. Het gaat hierbij uitsluitend om digitale gegevens. Voorts gaat het uitsluitend om persoonsgegevens die QVO Values óf met uw toestemming verwerkt óf om een     overeenkomst met u uit te voeren. De gegevens zullen in een gestructureerde, gangbare en machineleesbare vorm worden verstrekt. U heeft het recht om deze gegevens aan een andere verantwoordelijke over te dragen;
• Het recht om bezwaar te maken tegen profilering;
• Het recht om een klacht in te dienen bij een toezichthouder;
• Het recht om de gegeven toestemming in te trekken. Nogmaals, er kunnen zich omstandigheden voordoen waarin QVO Values bevoegd is om uw gegevens te blijven verwerken, met name indien de verwerking daarvan een vereiste is om aan de op QVO Values rustende juridische en wettelijke verplichtingen te voldoen.
